He aggrieved that Congress led UPA Government have miserably failed to safeguard Retail Investor from frivolous Real Estate Developers. Taking a dig at the much-abated “Real Estate Management (Regulation and Control) Bill” proposed in 2006 by the UPA Government to regulate Real Estate, Sh. Arun Singh said, “It seems that Congress Government was only interested in safeguarding the investments of Retail Investors to keep their President, Sonia Gandhi’s vested interests, their silence on the above Bill corroborates that Real Estate Developers have acceded to her demands”.


Advocating the immediate need of a Real Estate Regulator, Sh. Arun Singh stated, “Those opposed to the idea of a Regulator argue that the automobile Industry does not have a regulator, yet it produces world-class cars. But Real estate cannot be compared to any other industry, as the quantum of investment is very large. Moreover, there is no off-the-shelf delivery; between booking and delivery lies a gap of nearly two years.” 

He further added that the appointment of a regulator is expected to improve reliability and reduce the gap between what is promised and what is delivered”. Greater accountability of Real Estate Developers will enable greater confidence of the Investors. Once confidence level improves, the quantum of domestic and foreign investment coming into the sector will also rise substantially. He further argued that, in the pre-SEBI regime the quantum of FII investment in a year was a few millions dollars but today exposure is over $10 billion (Rs 46,000 crore) annually.

Sh. Ashok Goel, National Vice President, BJP Investor Cell added that in the current scenario, all regulations and controls apply only up to the stage when the developer gets the licence. Thereafter, there is no system for monitoring the implementation of projects or for taking action in case the final product does not match promised standards. Sh. Goel demanded that Government should enforce that Real Estate Developers should furnish Performance Bank Guarantees to ensure that they meet promises made to the buyers.

Sukhminderpal Singh Grewal, Punjab State Chief, BJP Investor Cell, congratulated Sh. Arun Singh and Sh. Ashok Goel, for conception of “Investor Helpline” to provide legal and professional aid to Retail Investors, and stated that it was a huge success in Punjab State.  Grewal added that they are receiving numerous complaints from Retail Investors on investorhelpline@bjpindia.in who have lost their hard earned lifetime savings to these frivolous Real Estate Developers and in the absence of a Regulator, these Investors are left with no other option but to move courts wherein justice is a distant dream.

He observed that delayed possession and signification variation in the quality of the final product from the initial promises made by the Real Estate Developers is the most common grievances of buyers. He further stated that, today, anyone is free to become a Real Estate Broker, without any educational or licensing pre-requisite. Many unscrupulous brokers operate hand in glove with the new developers. In lieu of a higher commission, they get clients to invest in the projects of new developers, despite being aware of the higher risks.

The panacea for most of these ills lies in having a regulator for the real estate sector with powers to penalise errant developers and brokers. Grewal further added that Developers divert funds meant for one project to another. Sometimes they take on more projects than their financial strength allows. This results in projects getting delayed. Grewal stated, “Appointment of a Real Estate Regulator, disclosure standards will improve. RED will have to make project-wise disclosures of fund flow (SEBI has made this mandatory already for industries), making diversion of funds more difficult.”

Investigation of Illegal Collection of Stamp Duty

Aaj Di Awaz 1 December, 2008,Jalandhar: BJP Investor Cell Chief of Punjab State, Sukhminderpal Singh Grewal today handed over the illegal Additional Stamp Duty collection matter to CBI Incharge Sh. Mahesh Aggarwal. Grewal stated that the above extortion across Punjab is a straight violation of Indian Stamp Act.The matter dates back to Capt Amarinder Singh led Congress Government, which issued an autocratic ordinance imposing additional 3% stamp duty on several transactions including immovable property. Later, Congress Government amended Indian Stamp Act and converted this ordinance into law by adding Section 3-C (inserted by Punjab Act No. 11 of 2005) in Indian Stamp Act and imposed an additional 3% Stamp duty and restricted the additional levy to areas of Municipal Corporations and Class I Municipalities by getting an amendment passed in Punjab Vidhan Sabha. Considering the colossal public outcry and protests the then Congress Government was forced to keep the areas of Class II and Class III Municipalities and Nagar Panchayats away from the effect of this amendment.


But the revenue officials unceremoniously recovered additional 3% levy in Class II, Class III and Nagar Panchayat areas all over the State burdening rural and sub-urban folks all over Punjab. It is worth mentioning that people transacting in Class II areas of Samana, Sirhind, Sunam, Ahmedgarh, Dhuri, Nakodar, Nawanshehar, Banga, Phillaur, Nurmahal, Dasuya, Urmur Tanda, Mukerian, Garshankar, Doraha, Raikot, Samrala, Ropar, Morinda, Kharar, Kurali, Guru Harsahai, Talwandi Bhai, Jalalabad, Zira, Jaitu, Giddarbaha, Bhuccho Mandi, Goniana, Rama, Maur, Budhlada, Jandialaguru, Patti, Tarantaran, Dhariwal, Dinanagar, Sultanpur Lodhi, Rampura Phul and Class III areas of Sangrur, Dera Bassi, Banur, Bassi Pathana, Amloh, Longowal, Bhiwanigarh, Lehragaga, Dhanuala, Tappa, Bhadaur, Kartarpur, Alawalpur, Adampur, Rahon, Gardhiwala, Haryana, Shamchurasi, Payal, Anandpur Sahib, Dharamkot, Sangat, Kotfata, Bareta, Majitha, Ramdass, Qadian, Dera Baba Nanak, Shri Hargobindpur, Fatehgarh Churian, Sujanpur and 29 other areas which fall within limits of Nagar Panchayats are made to pay excess levies unlawfully.

Section 3-C of Indian Stamp Act clearly states that additional stamp duty is applicable to only Municipal Corporation and Class-I Municipalities while it is horrendously charged in Class II, Class III Municipalities and in the areas of Nagar Panchayats and cited Section 3-C which reads as “Every Instrument mentioned in entry 23 of Schedule 1-A chargeable with duty under Section 3, shall in addition to that duty, be also chargeable with such duty, as specified in Schedule 1-B, if such an instrument is executed in the area failing within the jurisdiction of a Municipality or a Corporation or within the area of five kilometers from the outer limit of the Municipality or Corporation, as the case may be, as may be specified by the Collector. This shall be applicable only to Municipal Corporation and Class-I Municipalities”.

It is further clarified that as per Indian Stamp Act, “additional 3% Stamp Duty” cannot be levied over documents which are exempted from any Stamp Duty even in areas of Municipal Corporation and Class-I Municipalities but Revenue Officials are defying law and people are asked to pay additional 3% Stamp Duty by compulsion across Punjab. For instance, there is no Stamp Duty chargeable on transfer of ownership of Residential house from the name of father to his son or daughter etc. and only registration fee is chargeable as the same document is exempted from the Stamp Duty but the Revenue Officials are illegally forcing 3% additional Stamp Duty on the same, where the Stamp Duty itself is exempted, the question of paying additional Stamp Duty does not arise. Kindly conduct an enquiry against Capt. Amarinder Singh, former Chief Minister, former Revenue Minister and other bureaucrats responsible for the above omission and deceit with the people of Punjab.

Officials of Oil Companies and MC swindled 752 Cro

Ajit Ludhiana, 10th November,2008: BJP Investor Cell Chief,Punjab, Sukhminderpal Singh Grewal today handed over a letter to Chief Minister Prakash Singh Badal to inquire a major “Advertisement Tax Scandal” of a whooping 752 Crores committed by officers of Oil Companies and Municipal Corporations of Punjab. Oil Companies across India have installed Flex Hoardings to advertise their Products but till date they haven’t paid any Advertisement Tax applicable upon these Hoardings. There are over 68388 Retail Outlets all over India of which 5226 Retail Outlets are commissioned in Punjab.  These Retail Outlets have erected Flex Hoardings with an average 1000 sq. feet advertising space apart from other advertisement spaces such as Glow Facia and Signages which means Advertisement Tax on 52,26000 sq feet advertisement space is fleeced by these Oil Companies. This further calculates to a whooping loss of over 52 Crores per annum to Punjab Government only. Considering an average age of meager 6 years of these hoardings, as most of them were installed during Captain Amarinder Singh’s regime this amounts to a loss of over 752 Crores to the state exchequer. Grewal demanded that a CBI enquiry be ordered immediately and responsibility of erring and corrupt officials of these oil companies and Municipal Corporations be fixed and guilty be booked as per the rulebook. He further added that “Advertisement Mafia” is hand in glove with certain officials of Municipal Corporation and they are openly flouting landmark judgments of Honourable Punjab and Haryana High Court wherein the Honourable Court had banned any Hoarding within 100 m from any important road and demanded that the Government should immediately intervene to curb the menace and book the guilty.
