Ludhiana, 14th November, 2008: Senior BJP Leader and Punjab State Chief of BJP Investor Cell, Advocate Sukhminderpal Singh Grewal have served notices to District Commissioners all over Punjab under Section 166 of IPC and Section 80 of CPC for recovering unconstitutional and illegal additional 3% Stamp Duty from “Class-II”, “Class-III” Municipalities and Nagar Panchayats in their revenue districts violating Indian Stamp Act.
Grewal stated that Section 166 of IPC provided that 'whoever, being a public servant, knowingly disobeys any direction oflaw as to the way in which he is to conduct himself as a public servant, intending to cause, or knowing it to be likely that he will, by such disobedience, cause injury to any person, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both.'' The word 'injury' in the section as defined in the IPC means, "Any harm, whatever illegally caused to any person in body, mind, reputation or property." It is a non-cognisable offence providing both for imprisonment and fine.
Grewal added that notices are also issued section 80 of CPC for initiating civil proceedings against the erring Civil Servants and he will ensure that loss to be public will be personally recovered from them as per provisions of the law.
Grewal stated that he had already written a letter to Sd. Prakash Singh Badal and he is confident that the SAD-BJP Government will soon provide relief to people of Punjab. He added that he had also apprised Professor Rajindra Bhandari, BJP President of Punjab about the above “Jazia Tax” imposed by Capt. Amarinder Singh violating Indian Stamp Act and Party President had given him assurance that justice will prevail.
Grewal reiterated that he will ensure that the above violation of Indian Stamp Act should be revoked with immediate effect failing which appropriate legal action will be initiated against erring Bureaucrats under section 166 of IPC, section 80 of CPC and other provisions of law.
